Effective January 1, 2024, new legislation provides up to five days of leave following a reproductive loss event for employees who have been employed by the state and any political or civil subdivision of the state, including cities and counties at least 30 days before the leave event occurs.
Reproductive Loss Leave is available for eligible employees in the event of a failed adoption, failed surrogacy, miscarriage, stillbirth, or an unsuccessful assisted reproduction. Leave can be requested to be taken consecutively, and or nonconsecutively, but must be completed within three months of the reproductive loss event.
Reproductive Loss Leave (RLL) is separate from other leaves offered to employees for their serious illness or to care for a family member with a serious illness. RLL is generally unpaid, except that an employee may use personal Vacation credits, Personal Holiday (PH), Sick Leave credits, Compensatory Time Off (CTO), and in some cases related to miscarriage or stillbirth, are eligible for paid bereavement leave to cover their period of absence.
